Terms of Service

Plain English summary: Use SkyBy to identify aircraft overhead. Don't abuse the service. Subscriptions are handled by Apple. We're not liable if the app is wrong about a plane. That's the gist.

1. Acceptance of terms

By downloading or using SkyBy ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App. We may update these terms from time to time; continued use after changes constitutes acceptance.

SkyBy is an iOS application that identifies commercial aircraft flying overhead using publicly available ADS-B flight data, combined with flight schedule and route information from third-party aviation data providers. The App displays flight information including airline, route, aircraft type, and registration for entertainment and informational purposes.

3. Accuracy of flight data

Flight information displayed in SkyBy is provided for informational purposes only. While we make every effort to provide accurate data, we cannot guarantee that flight information is correct, complete, or current at any given time. Do not use SkyBy for navigation, safety-critical decisions, or any purpose where accuracy is essential. Flight data is sourced from community ADS-B networks and third-party APIs; SkyBy is not responsible for errors in source data.

SkyBy offers a free tier and a paid Pro subscription. The following terms apply to subscriptions:

The free tier of SkyBy provides access to core flight identification features with the following limitations: logbook history limited to the past 24 hours; catch radius limited to 1 nautical mile (the radius slider is visible but capped); no access to statistics and analytics tabs; no logbook search or filtering; no bookmarks; aircraft photos are a Pro-only feature. These limitations may change over time.

The SkyBy name, logo, app design, and original code are owned by SkyBy and protected by copyright. Aircraft photos displayed in the App are provided by Planespotters.net contributors under their respective licenses; SkyBy does not claim ownership of third-party photography. Flight data is sourced from public ADS-B networks and licensed third-party providers.

8. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers and limitation of liability

SkyBy is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that flight information will be accurate. To the maximum extent permitted by applicable law, SkyBy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to reliance on inaccurate flight data.

10. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may suspend or discontinue the App or any features at any time. In the event of service discontinuation, we will provide reasonable notice and cease charging subscriptions from the discontinuation date.

11. Termination

We reserve the right to terminate or suspend access to SkyBy for violations of these Terms. You may terminate your use at any time by deleting the App and cancelling any active subscription.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Los Angeles County, California.

If you are a consumer located in the European Union or European Economic Area, nothing in these Terms limits your rights under the mandatory consumer protection laws of your country of residence. EU consumers may also bring claims before the courts of their country of residence.
